    Terms of Service

    1. Agreement to Terms

    These Terms & Conditions (“Terms”) govern your access to and use of the website state48roofing.com and any services, content, and communications provided by State 48 Roofing LLC (“State 48 Roofing,” “we,” “us,” or “our”), a licensed roofing contractor (ROC #325352) operating in Arizona.

    By accessing our website, requesting a quote or inspection, communicating with us, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

    2. Eligibility

    You must be at least 18 years old and legally able to enter into a binding contract to use our website or services. By using our website or services, you represent and warrant that you meet these requirements.

    3. Services

    State 48 Roofing provides residential and commercial roofing services in Arizona, including but not limited to:

    • Roof inspections and consultations
    • Roof repairs and maintenance
    • Roof replacements and installations
    • Refelts, underlayment, and related services
    • Emergency roofing and leak repair

    All work is performed in accordance with applicable building codes, manufacturer specifications, and the Arizona Registrar of Contractors requirements.

    4. Estimates, Quotes, and Contracts

    Any estimate or quote we provide is for informational purposes and may be revised based on actual conditions, unforeseen circumstances, or changes in scope. A signed written agreement (the “Service Agreement”) governs the terms of any roofing work we perform, and its terms control in the event of any conflict with these Terms.

    Estimates are valid for the period stated in the estimate; if no period is stated, they are valid for 30 days from the date of issue. Pricing is subject to change based on market conditions, material availability, and the results of an in-person inspection.

    5. Payment Terms

    Payment terms will be set forth in your Service Agreement. Unless otherwise agreed in writing:

    • Deposits (if any) are required as stated in the Service Agreement
    • Final payment is due upon completion of the work
    • Accepted payment methods include check, credit/debit card, and approved financing
    • Late or unpaid balances may be subject to interest at the maximum rate permitted by Arizona law and to collection costs, including reasonable attorneys' fees

    6. Warranties

    Workmanship and material warranties, where applicable, will be described in your Service Agreement or provided separately in writing. Manufacturer warranties are issued by the product manufacturer and are subject to the manufacturer's terms.

    Warranty claims: Please contact us at (480) 698-4828 or info@state48roofing.com to initiate a warranty claim. We will respond within a reasonable time and work with you to resolve the issue under the applicable warranty terms.

    Warranties do not cover damage caused by acts of God, extreme weather, negligence, unauthorized modifications, lack of maintenance, or normal wear and tear.

    7. Customer Responsibilities

    You agree to:

    • Provide accurate information about your property and needs
    • Provide reasonable access to the property for inspection and work
    • Remove or secure personal property, vehicles, and fragile items from the work area
    • Inform us of any known hazards, easements, or property conditions
    • Comply with payment terms in the Service Agreement
    • Obtain homeowner association (HOA) approvals where required

    8. Website Use and Acceptable Use

    You agree not to use our website to:

    • Violate any applicable law or regulation
    • Infringe on the rights of others, including intellectual property rights
    • Upload viruses, malware, or any other malicious code
    • Attempt to gain unauthorized access to our systems or accounts
    • Scrape, harvest, or collect information from the website by automated means
    • Submit false, misleading, or fraudulent information
    • Harass, threaten, or impersonate others

    We reserve the right to refuse service, suspend, or terminate your access for any violation of these Terms.

    9. Intellectual Property

    10. User-Submitted Content and Photos

    If you submit photos, comments, reviews, testimonials, or other content to us (for example, through our website, text, email, or social media), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and display that content in connection with our business and marketing, unless you specifically request otherwise in writing.

    The warranties for our roofing services are limited to those expressly stated in your Service Agreement or written warranty documents.

    16. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, State 48 Roofing LLC and its officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or related to your use of the website, our services, or these Terms, even if we have been advised of the possibility of such damages.

    Our total aggregate liability for any claim arising out of or related to these Terms or your use of the website shall not exceed the greater of (a) the amount you paid to State 48 Roofing for the specific service giving rise to the claim, or (b) $100.00. Nothing in these Terms limits liability that cannot be limited under Arizona law.

    17. Indemnification

    You agree to indemnify, defend, and hold harmless State 48 Roofing LLC and its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the website or services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any content you submit to us.

    18. Governing Law and Venue

    These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or your use of our website shall be filed exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

    19. Dispute Resolution

    Before filing any legal action, you agree to first attempt to resolve the dispute informally by contacting us in writing at the address or email listed below. We will attempt in good faith to resolve the dispute within 30 days. If we cannot resolve the dispute informally, either party may pursue legal remedies as set forth in these Terms.

    Any disputes related to roofing services performed under a Service Agreement are also subject to the dispute resolution procedures described in that Service Agreement and may be subject to the Arizona Registrar of Contractors' complaint process.

    20. Severability

    If any provision of these Terms is found to be unenforceable, invalid, or illegal, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

    21. No Waiver

    Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

    22. Entire Agreement

    These Terms, together with our Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and us regarding the use of our website and services, and supersede any prior agreements on those topics. Your Service Agreement governs the roofing work itself; these Terms govern your use of the website and general interactions with us.

    23. Changes to These Terms

    We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new Effective Date. Your continued use of the website or services after an update constitutes your acceptance of the updated Terms.
